By using the WebFluteAcademy website ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service").
“Services” means Supplier’s hosted internet accessible learning management solution service, under the name Web Flute Academy, made available to You by TalentLMS eLearning platform on a free account term basis under the Agreement at a website address WebFluteAcademy.org or webfluteacademy.talentlms.com, provided to You (“Portal”).
Web Flute Academy reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service and Privacy Policies at any time on this page.
Violation of any of the terms below will result in the termination of your Account. You agree to use the Service at your own risk.
You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
Your login may only be used by one person - a single login shared by multiple people is not permitted.
You are responsible for maintaining the security of your account and password. Web Flute Academy cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You are responsible for all Content posted and activity that occurs under your account (for example, participation in Discussions).
One person may not maintain more than one account.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Payment and Refunds Terms
We guarantee a refund in case you are not satisfied by a course you have signed up for. For refunds, contact us at email@example.com
Cancellation and Termination
You are solely responsible for properly cancelling your account by logging in and deleting your account or by sending us such request at firstname.lastname@example.org
Web Flute Academy, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service at any time and without prior notice in case of (a) fraudulent, criminal, grossly negligent, willful, or otherwise intentional misconduct, or violation of any law or regulation, in connection with the performance of your obligations here under and/or (b) demonstrated usage negatively impacting the performance of the Service and/or (c) breach of the herein Service terms and conditions. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all content in your Account or any other similar action deemed appropriate.
Modifications to the Service and Prices
Prices of all Services are subject to change at any time. Such notice may be provided at any time by posting the changes to the Service itself.
Web Flute Academy shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
Technical support is only available via email.
You understand that Web Flute Academy and TalentLMS use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service.
You agree not to perform misrepresentation of yourself, or disguising the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with Web Flute Academy or any third party).
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Web Flute Academy.
You agree not to violate the privacy of others, including publishing or posting other people's private and confidential information without their express permission, or collecting or gathering other people’s personal information (including account names or information) from Web Flute Academy.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
We retain the right to contact you from time-to-time via email. You can remove yourself easily from the newsletter lists. You can also request to be removed from all communication emails by contacting our support at email@example.com or a message via your account.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Web Flute Academy customer, employee, member, or officer will result in immediate account termination.
You expressly understand and agree that Web Flute Academy shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
The failure of Web Flute Academy to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Web Flute Academy and govern your use of the Service, superseding any prior agreements between you and Web Flute Academy (including, but not limited to, any prior versions of the Terms of Service).
Web Flute Academy and TalentLMS have a right to determine that a user has violated these Terms of Service.

1.0 What is Web Flute Academy?
Web Flute Academy is an online institution, offering an innovative way to learn the flute by blending best e-learning tools and live video meetings
We use “Web Flute Academy” here to refer to the Web Flute Academy website and our services, offered through iOS and Android apps (also referred to as our Services) that provide you with access to that platform. We also use “Web Flute Academy”, “we”, “us” and “our” to refer to the companies operating our Services.
2.0 Who provides the Services and controls my information?
Web Flute Academy was founded by Onorio Zaralli and Yulia Berry. Only the two founders have an access to your personal information, such as your email address and your academic progress in using our online courses.

3.0 Our legitimate interests
We process your information in furtherance of the following legitimate interests:
Keeping the Services safe and secure: We use your information because it is necessary to pursue our and our members’ legitimate interests in ensuring Web Flute Academy is secure, such as implementing and enhancing security measures and protections, protecting against fraud, spam and abuse, and enforcing our Member Agreement.
Providing, improving, and developing the Services: We use your information to provide the Services, including any personalized services. We do so as it is necessary to pursue our legitimate interests of providing an innovative and tailored offering to our members on a sustained basis.
4.0 Information we collect
When we provide the Services, we collect or receive information in several different ways. In many cases you choose what information to provide. Some information is required in order to use Web Flute Academy and for us to provide the Services. We use this information for the purposes described further below.
4.1 From you, or with your permission. We collect a variety of information from you when you provide it to us directly, when we request it from you, or when you give us permission to get it from a third party source. We provide some examples of these below:
When you sign up for Web Flute Academy, you provide your name and email address. You might choose to use your social account login information (Facebook, Google or Linkedin). You create your account name and password.
If you use Facebook to log into Web Flute Academy, you authorize Facebook to share your personal information with us, including your name and email address.
If you want to communicate with other users in discussions, available through this platform and share Content (as defined in our member agreement), you might post something on Web Flute Academy.
If you contact support, you are providing us with your contact information and a description of the issue so we can respond.
4.2 From your browser and device. Like nearly every other online service, we automatically collect technical information when you visit or use Web Flute Academy or read a message from us. We collect information from your browser, computer, or mobile device. This provides us with technical information when you use Web Flute Academy as a visitor or member, including:
Device data which tells us about the device you’re using, what type and model it is, its operating system and version, its unique identifier, crash data (if applicable), and what settings you’ve enabled. Your device and software settings affect what information your device makes available to us.
Log data which is automatically recorded by our servers based on data sent by your app or browser. This typically includes the date and time you visited and how you used Web Flute Academy (for example, which courses you signed up for and your academic progress).
Cookie data which comes from “cookies” (small data files stored on your computer or mobile device) and similar technologies. Cookie data helps us recognize you, remember your preferences, and learn more about you. Some, but not all cookie data is associated with your Web Flute Academy account. You can configure your browser to reject cookies, but doing so will prevent you from logging into our website.

We use the information we have to help us provide, operate, improve, understand, customize, support, and market our Services.
5.1 Creating and marketing our courses and webinars. We use information from your surveys and given feedback to identify new topics of interest, offering webinars and crafting new courses.
5.2 Provide and improve the Services. We use information to operate Web Flute Academy and improve our products and features:
To help you to study flute online through our offered courses and webinars.
To understand the aggregate and anonymized trends and usage statistics.
To respond to your support requests and comments.
To test and evaluate potential new courses and webinars on Web Flute Academy.
To diagnose and resolve problems, analyze trends, and monitor aggregate usage and resource needs.
For our own marketing activities, such as carrying out analysis to create statistics on and insights into the use of our Services.
5.3 Advertising. We use information to provide and improve advertisements and other commercial offerings:
To measure whether an advertisement was interesting to members.
To measure whether an advertisement was effective for the advertiser.
To help personalize advertisements based on what we think will be of interest to you.
We may customize advertising offerings you see on Web Flute Academy based on information from our advertisers or vendors or on your actions on Web Flute Academy. (For example, through your feedback or suggestions in our member discussions)
6.0 Your Choices
You have controls over what information is shared and how it is used. We delineate here, the choices you have regarding the sharing and visibility of profile information your location information, your choices about communications, invitations and reminders, how and when your Content is shared, and deactivating or deleting your Web Flute Academy account.
7.0 Your Rights
You benefit from a number of rights in relation to your information that we process. While some of these rights apply generally, certain rights apply only in certain limited cases. We describe these rights below.
7.1 Access and porting. You can access your Web Flute Academy information by logging into your Web Flute Academy account. For EU member accounts, if you require additional access, email us at firstname.lastname@example.org to request a copy of your Web Flute Academy information. Where legally required, we will provide your information in an easily accessible format and assist in transferring some of this information to third parties.
7.2 Delete. You can also delete your Web Flute Academy information by logging into your Web Flute Academy account. If you need help, please contact us at email@example.com. As described above in ‘Your Choices’, you can delete your information, including your Web Flute Academy account or send us such request and we will delete it..
7.3 Object. If we process your information based on our legitimate interests explained above, or in the public interest and you have an EU member account, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your data for direct marketing, you can always object by using the unsubscribe link in such communications, changing your account settings or by contacting us.
7.5 Complain. If you have an EU member account and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority.
8.0 Sharing information with third parties
We share information with service providers, affiliates, partners, and other third parties where it is necessary to perform the Member Agreement, to provide the Services, or for any other purposes described in the Policy.
8.1 Sharing Content with other users of our site. Web Flute Academy is a platform for flutists to share helpful information with each other. To that end, we make the Content you post on Web Flute Academy, such as posts, replies, messages, and profile information available to other Web Flute Academy members based on the preferences in your settings, the preferences on the Content you provide, and as described in this Policy.
8.2 Marketing and spam. We know that you do not want spam or marketing calls from third parties, so we will never sell or rent your contact information to third parties, and we won’t share it with a third party unless we have your authorization.
8.3 Third party service providers. We may share your personal information to help us operate, provide, improve, understand, customize, support, and market our Services. These third parties are contractually required to use it only to provide their service to us, and contractually barred from using it for their own purposes. (For example, we use a company to help test and analyze the performance of our website and mobile applications.)
8.4 Legal and safety reasons. We may retain, preserve, or share your personal information if we have a good-faith belief that it is reasonably necessary to (a) respond, based on applicable law, to a legal request (e.g.a subpoena, search warrant, court order, or other request from government or law enforcement); (b) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; (c) protect our rights, property, or safety; (d) enforce our Member Agreement or any other agreements we have with you; (e) prevent physical injury or other harm to any person or entity, including yourself and members of the general public.
9.0 Data transfers
If you live outside the United States, we transfer personal data outside the EU in accordance with EU data protection law, including where it is necessary to provide the Services and perform the Member Agreement.
9.2 Privacy Shield. We may also rely on the EU-US Privacy Shield where we transfer your information to the United States, such as to certain of our third party service providers, where such recipients are certified to receive your information under the Privacy Shield Program.
By continuing to use Web Flute Academy, you understand that we may transfer and store your data outside your home country, including to and in the US, as described in this Policy. The privacy protections and the rights of authorities to access your personal information in some of these countries may not be the same as in your home country. Web Flute Academy will only transfer personal data as permitted by law, and will take steps intended to ensure appropriate protection of your personal information.
10.0 Data retention
We may retain your information in our server logs, our databases, and our records for as long as necessary in light of the purposes set out in this Policy, subject to any legal obligations to further retain such information. We may retain your verification-related information for a reasonable period of time (even if you do not complete all verification steps) to assist with future verifications and to prevent abuse of our verification processes. If you decide not to verify the account and would like us to delete the verification information you provided, contact us.
11.0 Additional information
11.1 Account security. Web Flute Academy uses technical and organizational measures intended to keep your data secure, including using https on our web pages to reduce the risk of unauthorized interception of your communications during your visits to the website. However, the internet is not a fully secure environment and we cannot guarantee that your personal information won’t be intercepted or improperly accessed. Please ensure that you keep your password safe and do not share it with anyone.
11.2 Other Services and websites. In using Web Flute Academy, you may come across links to websites and services operated by third parties (for example, if a member shares a link to a video on YouTube, or if an advertiser provides a link to a contest or sweepstakes). These third parties have their own privacy policies, which will apply to your activity if you click on the link and access their website or service. We do not accept any responsibility or liability for such external sites’ privacy and security practices.
11.3 Amendments to the Policy. From time to time we may make changes to this Policy, so please review it periodically. If we materially change our Policy, we will take steps to notify you in advance of the change, for example by emailing you or by posting a notice in your neighborhood feed.
